Supreme Court summons influencers over derogatory remarks on disabilities

Delhi – Net News: The Supreme Court of India has summoned five social media influencers, including comedian Samay Raina, following allegations of making derogatory remarks about individuals with disabilities, particularly those suffering from Spinal Muscular Atrophy (SMA), on their online platforms.
Background of the case
As per the reputable news sources, the NGO Cure SMA Foundation of India filed a petition alleging that certain influencers mocked individuals with disabilities during a show titled “India’s Got Latent.” Specific instances highlighted include jokes about the high cost of SMA treatment and insensitive comments directed at visually impaired individuals.
Supreme Court’s response
A bench comprising Justices Surya Kant and N Kotiswar Singh expressed serious concern over the allegations, stating that such conduct is “damaging” and “demoralising.” The court emphasized the need for remedial and punitive actions to prevent recurrence.
The court directed the Mumbai Police Commissioner to issue notices to the accused influencers, mandating their appearance before the court. Failure to comply may result in coercive actions.
Call for regulatory guidelines
The bench also sought the assistance of Attorney General R Venkataramani to formulate guidelines regulating social media content related to disabilities and rare diseases. The court underscored that freedom of speech does not permit demeaning behavior towards vulnerable groups.
NGO’s standpoint
Cure SMA Foundation highlighted gaps in the existing legal framework, advocating for explicit protections against content that denigrates persons with disabilities. The NGO clarified that it does not seek a blanket ban but targeted regulation to curb offensive portrayals.
The Supreme Court has requested a comprehensive writ petition from the NGO, detailing specific instances, offenders, and suggested regulatory measures. The matter is scheduled for further hearing on July 15.
